Plain-language terms for trying pre-release software. Please read them before you install.
In short
- This public beta is free during the testing period. The current Windows portable and Linux testing builds are unsigned; native GUI and hardware sleep/wake behavior remain unverified. They may have bugs and may not work with your TV.
- It is a household convenience tool, not a security or parental-control guarantee. Anyone with computer access can pause or quit it.
- Use the beta for personal, noncommercial household evaluation. Do not rely on it where a failure could cause harm.
- Where the law lets us, our responsibility is limited. Your rights under consumer law are not affected.
These terms apply to the TV Night Guard beta software (“the beta”) and to tvnightguard.com (“the site”), both provided by Gradient Noise, Inc. (“we”, “us”). By downloading or using the beta, you agree to them. Last updated for the 0.1.0-beta.4 release.
1. The beta
The beta is publicly available pre-release software offered free during the testing period for evaluation. You may use and copy it unchanged for personal, noncommercial household beta testing. If you share unchanged copies, keep the privacy notice, compatibility notes, and third-party notices with them. This permission does not allow you to sell the application or use its branding for another product. The beta license contains the release-specific evaluation terms.
The source archive is supplied to the project owner for development only; it is not an open-source license grant. Third-party components remain governed by their respective licenses. See the third-party notices.
We may change, suspend, or end the beta at any time. The beta is free during testing; future pricing has not been announced. Taking part in the beta does not entitle you to future free access, a particular price, or any future version.
2. What the beta does and does not do
Beta.4 expires October 28, 2026 at 08:40:28.369 UTC (2026-10-28T08:40:28.369Z), 30 days after build time—not installation. After expiry, TV-control functions stop; diagnostics and cleanup remain available, and local data is retained. A newer build is required to continue testing. Stable, non-testing releases are not subject to this testing-build timer.
During quiet hours you set, the beta checks enabled TVs and sends an off command when a compatible TV reports it is on. It depends on your computer staying on, signed in, connected, and running the app; on your network; and on how your TV responds. It does not turn TVs on. It is not tamper-resistant and is not a substitute for supervision, parental-control products, or safety devices.
Compatibility is described on the compatibility page. A listed platform does not guarantee that your model or firmware will work. The required off test is how you confirm it for your TV.
3. Unsigned software
The current public downloads are unsigned Windows portable and Linux evaluation builds; Windows installer and Mac DMG packaging remain pending. Download only from this site and compare published checksums. Do not disable antivirus or other security protection. Compatibility, setup, and beta limitations are described in the compatibility notes and release README.
4. Your responsibilities
- Only pair and control TVs you own or are authorized to control.
- Use the beta lawfully and do not try to disrupt the site or feedback service.
- Do not send us pairing tokens, pre-shared keys, passwords, or application-data folders.
5. Feedback
If you send feedback, you allow us to use it to improve TV Night Guard without owing you payment. We handle any personal information in it as described in the privacy notice.
6. No warranty
To the extent permitted by applicable law, the beta and the site are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the beta will be error-free, work with any particular TV, turn off a TV within any particular time, or operate without interruption.
7. Limitation of liability
To the extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from the beta or the site. To the same extent, our total liability for any claim relating to the beta or the site is limited to the greater of the amount you paid us for the beta (currently nothing) and US $50.
8. Rights that cannot be waived
Some jurisdictions do not allow certain warranties to be excluded or liability to be limited. Nothing in these terms excludes or limits any liability, warranty, or consumer right that cannot legally be excluded or limited where you live, including liability for death or personal injury caused by negligence, or for fraud. In those places, the exclusions and limits above apply only to the extent permitted.
9. Ending use
You may stop using the beta at any time by quitting and uninstalling it. We may end your license if you break these terms. Sections 5 through 8 continue to apply afterward.
10. Trademarks
Samsung, The Frame, LG, webOS, Sony, BRAVIA, Vizio, SmartCast, Roku, Google TV, Android TV, Fire TV, and Windows are trademarks of their respective owners. They are mentioned only to describe compatibility. TV Night Guard is not affiliated with or endorsed by them.
11. Changes
We may update these terms as the beta changes. We will post the updated terms on this page. If you keep using the beta after an update, the updated terms apply from then on.
